ERP & EnterpriseUAE E-Invoicing ASP Rules Changed: What Ministerial Decision 168 Means Before 30 October
Ministerial Decision No. 168 of 2026 took effect on 1 October and removes the pre-approval stage for eInvoicing service providers. Existing providers with preliminary approval have 30 days to complete full accreditation or lose it.
On 9 October 2026 the Ministry of Finance published Ministerial Decision No. 168 of 2026 on eligibility criteria and accreditation procedures for service providers under the Electronic Invoicing System. It entered into force on 1 October 2026 and repeals Ministerial Decision No. 64 of 2025 and its amendments, including No. 56 of 2026.
The practical change is the end of the pre-approval stage. That stage existed while the ecosystem and interoperability were still being built. Under the new rules, a provider must complete a full accreditation assessment and testing before it is approved to operate. The Ministry described this as the programme moving from development and testing into a live ecosystem.
What changes for providers, and what does not
Providers that already held preliminary approval under the old framework have up to 30 days from 1 October 2026 to meet the new requirements. A fresh application is not required unless the Ministry says otherwise. If the requirements are not met in that window, the preliminary approval terminates.
The decision keeps the flexibility introduced earlier that lets providers use third-party Peppol Service Provider products and outsource elements of development, operation, or management, provided they retain full responsibility for compliance and delivery. It also sets procedures for renewal, ongoing evaluation, termination, and a formal objection process.
None of this moves the taxpayer deadlines. Businesses with annual revenue of AED 50 million or more still appoint an Accredited Service Provider by 30 October 2026 and issue through the system from 1 January 2027. The appointment date is unchanged. The list of providers you can safely appoint is the part that tightened.
What a Phase 1 company should check this week
The risk is not that your chosen provider suddenly disappears. The risk is signing with a name that still shows as “preliminary” and then discovering the accreditation did not complete. Ask for the current accreditation status in writing, not a slide from May.
- Confirm the provider appears on the Ministry’s central register after the new framework, or has documented progress toward it inside the 30-day window.
- Ask whether any part of the service is outsourced and who remains contractually responsible if a third-party Peppol component fails testing.
- Re-check the data feed from your ERP or billing system. An accredited provider still needs clean buyer TRN, legal name, VAT category, and credit-note references. Accreditation does not fix a free-text item master.
Cabinet Decision No. 106 of 2025 still sets the AED 5,000 per month penalty for failure to implement or appoint on time. That clock does not pause while providers finish their own paperwork.
If you are under AED 50 million
You are on Phase 2 (appointment by 31 March 2027, go-live 1 July 2027). The same accreditation rules apply to the providers you will shortlist in Q1 2027. Starting the ERP field cleanup now still reduces the gap between appointment and first structured invoice. See the Phase 2 note for the exact sequence.
The software work remains the same shape: map the fields the PINT-AE format requires, clean the master data, and only then lock an ASP. If you want that mapping scoped against the system you already run, that is the readiness step that sits in front of the 30 October or 31 March appointment.
